Official Rules for the “Taste of Authenticity” Recipe Contest

By participating in this Contest you declare that you have read the Official Rules below AND THAT YOU FULLY AGREE TO ALL OF THESE TERMS AND CONDITIONS.
DATES OF PROMOTION: The Saputo Cheese USA Inc. Stella® “Taste of Authenticity” Recipe Contest (the “Contest”) starts at 12:00:01 AM Eastern Time on November 1, 2017, and ends at 11:59:59 PM Eastern Time on January 12, 2018 (the “Entry Period”).
ELIGIBILITY: Contest is open to all legal U.S. residents physically residing in the 50 United States and District of Columbia who are 18 years of age or older, as of November 1, 2017, and have reached the age of majority in the state of residence. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live; or persons living in same household, whether related or not) of Saputo Cheese USA Inc. (the “Sponsor”), its affiliated companies, advertising and promotion agencies, and any other entities directly associated with this Contest (collectively, “Released Parties”) are not eligible to enter or win. Void in Puerto Rico, U.S. territories and possessions, U.S. military installations in foreign countries and where prohibited or restricted by law. Winning a Prize, as defined below, is contingent upon fulfilling all requirements set forth herein.
The Contest is open only to amateur home cooks. No person who has received compensation for his/her cooking or who is applying to or enrolled in a degree program at a cooking school may enter.
Entries from anyone who has been a prize winner in any contest or sweepstakes sponsored by the Sponsor in the twelve (12) months prior to the Contest start date are ineligible and will NOT be considered.
HOW TO ENTER: Log on to www.stellacheese.com during the Entry Period and click on the “Enter to Win” button on the homepage which will link to an online Contest entry form (the “Entry Form”). Fill out the Entry Form by providing your first name, last name, address, city, state, ZIP, daytime phone number (including area code), e-mail address and age. Complete Contest Entry Form, including an original recipe using at least one Stella® Cheese product (“Recipe”) and an original name for the Recipe (together with the Recipe, an “Entry” or “Entries”). Once all necessary fields are completely filled out, submit your Entry Form by clicking the “Send” button. A thank-you message will be displayed to confirm that your Contest Entry Form was successfully sent. Each entrant who fully completes the Entry Form will receive one (1) Entry into the Contest.
Entrants must complete the entire Entry Form in order to successfully enter into the Contest. If the Entry Form is aborted before it is complete, the entrant will not be deemed to have made a qualifying Entry. Incomplete Entries and Entries not complying with these Official Rules are subject to disqualification. No correspondence regarding Entries will be acknowledged or entered into with entrants. In the case of disputes, Entries will be deemed made by the Authorized Account Holder (as defined below) of the e-mail address submitted at the time of Entry.
ENTRY DETAILS: The Recipe must: 1) include detailed, step-by-step preparation instructions, 2) list each ingredient in exact common U.S. household measurements and order of use in making the Recipe, and 3) indicate cooking times and number of servings. If a Recipe contains a brand name cheese product or a trademark other than Stella® Cheese, Sponsor may disqualify the Entry or, at its sole discretion, remove the brand name or trademark from the Entry prior to judging without notice to entrant. The Recipe must be an original recipe that was created by the entrant and cannot have previously won a contest or other promotion. Recipe must not have been previously published, must not be awaiting publication, nor may it be submitted for publication consideration during the Entry Period.
By submitting an Entry, you hereby (i) represent and warrant that the Recipe is your own original work and complies with all the Entry requirements set forth in these Official Rules and (ii) grant Sponsor an irrevocable, unlimited, worldwide, perpetual license and right to reproduce, publish, use, modify, edit, excerpt, and publicly display and make the Recipe in any way, in any and all media, now known or created in the future, without any right to review or approve any use or changes, and without payment of any consideration to you or any attribution to you. You agree that your Entry is freely made, without restriction.
If your Entry is selected as a Finalist (as defined below), in consideration of having your Entry judged as a potential Prize Winner, you hereby transfer and assign to Sponsor all of your right, title and interest in and to the Recipe, including without limitation all copyrights and other intellectual property rights. Upon your notification as a Finalist, Sponsor shall be the sole and exclusive owner of your Recipe.
LIMIT: One (1) Entry per person per e-mail and/or mailing address per day during the Entry Period.
JUDGING: A qualified panel of independent judges (the “Judges”) will review all of the Entries and will select thirty (30) finalists (the “Finalists”) that comply with the Official Rules and achieve the highest point total. Points will be awarded on a 1-10 scale (1 being the least points and 10 being the most points) for each of the following weighted categories: appropriate application/use of one (1) or more Stella® Cheeses (50%) and creativity/originality of the Recipe (50%). In the event of a tie, the Entry with the higher score first in the use of cheese criteria and then in the creativity/originality criteria will be declared the Finalist from the tied Entries. If a tie continues, the tied Entries will be re-judged by a new judge using the original criteria. The Finalists will be chosen on or about January 17, 2018, and Entrants whose Entries were selected as Finalists will be notified by email on or about January 19, 2018.
Three (3) Prize Winners (as defined below) will be selected by the Judges from the pool of Finalists. There will be a 1st, 2nd and 3rd place winner. The Prize Winners will be chosen on or about February 9, 2018.
All Finalists will be tested and judged by the Judges according to originality, taste and appropriate use of Stella® Cheeses. Points will be awarded on a 1-10 scale (1 being the least points and 10 being the most points) for each of the following weighted categories: appropriate application/use of one (1) or more Stella® Cheeses (25%), taste (50%), and creativity/originality of the Recipe (25%). In the event of a tie, the Entry with the higher score first in the taste criteria and then in the use of cheese criteria will be declared the winner of the tied Entries. If a tie continues, the tied Entries will be re-judged by a new Judge using the original criteria. Decisions made by the Judges are final.
PRIZES: Three (3) prize winners (“Prize Winner”) will each receive a Visa® gift card (the “Prize”). 1st place will receive a $3,000 Visa® gift card, 2nd place will receive a $1,500 Visa® gift card and 3rd place will receive a $500 Visa® gift card. Visit www.usa.visa.com to view additional gift card terms and conditions that may apply. The Approximate Retail Value (“ARV”) of all Prizes is $5,000.
Prize is subject to availability and other restrictions. All federal, state and local taxes, including, but not limited to, any taxes imposed on the income of the Prize Winner as a result of winning the Prize and all other expenses not specifically mentioned herein as part of the Prize are solely the responsibility of the Prize Winner.
Prize is non-transferable and no cash redemption or substitution allowed, except at Sponsor’s sole and absolute discretion. Sponsor reserves the right at any time to substitute the Prize for any reason with a prize of equal or greater value, including, without limitation, at the Sponsor’s sole discretion, a cash award.
NOTIFICATION OF WINNERS /CLAIMING PRIZE: Sponsor will attempt to notify the potential Prize Winners by e-mail, phone and/or mail at the address provided within ten (10) days of the judging. If a potential Prize Winner cannot be reached within seven (7) days of initial attempt and/or fails to respond to any notification attempt within seven (7) days, or if any attempted notification or Prize delivery is returned as undeliverable, the Prize Winner will be forfeited. Sponsor will select an alternate potential Prize Winner in his/her place based on the scores received during the official judging session.
Prize Winners will be required to complete and return to Sponsor, within seven (7) days of being notified, documentation as reasonably requested by Sponsor (“Winner Documents”), including for example a Prize Acceptance, Affidavit of Eligibility, Release of Liability, photocopy of driver’s license or government I.D. and/or, if legally permissible, a Publicity Release, in order to claim the Prize. If potential Prize Winner cannot be contacted within seven (7) days of the first attempt to contact him/her or if he/she fails to return Winner Documents as requested, within the required time period, potential Prize Winner forfeits his/her right to the Prize and an alternative Prize Winner will be selected, time permitting.
GENERAL RULES OF PARTICIPATION: No purchase necessary to enter Contest or win a Prize. This Contest is subject to all applicable federal, state, local and municipal laws. By participating, you agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules.
In the event of a dispute regarding the identity of an individual who actually submitted an online Entry, the Entry will be deemed submitted by the Authorized Account Holder of the e-mail account provided in the Entry Form. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential Prize Winner may be required to show proof of being the Authorized Account Holder.
If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest, in whole or in part, and judge from those eligible Entries received up to the cancellation/suspension date.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
INTERNET LIMITATIONS OF LIABILITY: Sponsor is not responsible for: lost, late, misdirected, undeliverable or incomplete Entries; failures or malfunctions of phones, phone lines or telephone or data transmission systems; interrupted or unavailable network, server or other connections; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or any technical problem, including but not limited to any injury or damage to any person's computer related to or resulting from Contest participation; or other problems or errors of any kind whether computer, network, mechanical, human, electronic, typographical, printing or otherwise relating to or in connection with the Contest.
NO LIABILITY; RELEASE AND INDEMNIFICATION: By entering this Contest, you agree to release, discharge, indemnify and hold harmless the Released Parties and each of their respective officers, directors, employees, representatives and agents from and against any claims related in any way to the operation of this Contest as well as any cost, expense, damages or liability (including all attorneys’ fees and court costs) due to any injuries, death, damages or losses to any person or property of any kind, or violations or infringement of any rights of publicity or privacy, or claims of defamation or portrayal in a false light, resulting in whole or in part, directly or indirectly, from participation in this Contest or acceptance, use, misuse or loss of the Prize.
DISPUTES: THIS CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF ILLINOIS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN COOK COUNTY, ILLINOIS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. PARTICIPANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY PARTICIPANT AND/OR RELEASED PARTIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. ANY DEMAND MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE CONTEST PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.
PUBLICITY RELEASE: Except where prohibited by law, Prize Winner consents to the use of his/her name, likeness, biographical information, and voice in advertising worldwide without additional compensation (TN residents will not be required to sign a publicity release as a condition of winning the Prize).
